In arranging insurance for our customers, we will act as an independent immediately advisor and have access to a range of insurers in the market. We will discuss with your current situation taking into account your own personal circumstances and needs so we are able to make an informed decision based on our advice. We operate on an ‘Advised’ basis. This means that all our senior agents adhere to FCA guidelines to give a tailored and personal recommendation that has been discussed in detail with yourself. We can also assist you in making a future claim. We will give you full details of any such arrangement before you make any commitment on any product.
It is your responsibility to provide complete and accurate information to us and insurers when you take out an insurance policy, throughout the life of the policy, and if/when you renew your policy. Failure to disclose facts pertaining to your insurance, or any inaccuracies in information given, could result in your insurance being invalid or not operating fully.It is important that you ensure all statements you make on a proposal forms, claim forms, and other documents is true, full and accurate. If a form is completed on your behalf, you should check that the answers shown to any questions are true and accurate before signing the document.You are advised to keep copies of any correspondence you send to us or direct to the insurer.
Confidentiality & Data Protection / Access to records by a regulator or complaints body
All personal and sensitive information about our customers is treated as private and confidential. Unless we are notified of any changes, we shall assume the personal and sensitive data we hold about our customers is correct and shall use it to provide quotations when polices fall due for renewal.In the interest of security and to improve our service, telephone calls may be monitored and/or recorded for training and regulatory purposes. Under the Data Protection Act 1998, individuals have a right to see personal information about them that we hold in our records. A charge may be made for this service. If you wish to exercise this right, or have any other related queries, you should write to the address stated above. Data will not be transferred by us to any other firm or company with the exception of Insurers and our Compliance Officer. We may also provide information to our regulators and their successors (where we are required to do so by law) and pass information about you and details of your payment record with us to credit reference agencies for the purpose of arranging payments by instalments.
It is our intention to provide you with a high level of customer service at all times. Cancellation Rights and Charges
You have a legal right to cancel your policy for any reason, subject to no claims having occurred, within 14 days of receiving the full terms and conditions from your Insurer and the Terms of Business from us.We reserve the right to charge a cancellation fee should you cancel the policy outside of the initial cancellation period. For any of our protection products, the cancellation fee is full repayment of all outstanding commissions we received pro-rata over a period of 48 months, or a £100 cancellation fee, which ever amount is greater, starting from the last direct debit payment you made to the Insurer before cancelling. All broker fees are non-refundable.The cancellation charges written in this Terms of Business are explained to you during the phone call at the time you agreed to take out the insurance policy. If you would like a copy of this recorded phone call, then you can request it from us. All payments are made directly to the insurance provider by direct debit. No other method of payment is accepted. All direct debits are setup to your nominated bank account at the time of sale.You are able to select your preferred direct debit payment date which will be taken from your nominated account each month. If you wish to change your nominated direct debit date, please contact the insurance company which has provided you cover directly. All direct debits are protected by the direct debit guarantee scheme.
All quotations are subject to change in respect of the amount of premium indicated and/or the Terms and Conditions that are applied.
Policy Terms, Conditions, and Warranties
You should read through all policy terms, conditions and warranties shown on your policy documentation. Please ensure you understand them and are able to follow their requirements exactly. If not, please inform us immediately as a breach of any Terms, Conditions or Warranties may enable your insurer’s to terminate your policy from the date of that breach and/or any claim under your policy.
Renewal of premiums
In good time before the renewal of your policy, we shall contact you with the renewal premium and terms for the coming year. If you have not contacted us before the renewal date, we shall renew the policy automatically on your behalf.If it is your intention to renew the policy, no action is required by you and the policy will renew automatically. If you do not wish to renew the policy, please let us know as soon as possible in writing. We should also advise you to cancel your direct debit instruction with your bank to the renewal date.
Our remuneration will be a commission payment paid by the insurer. We may, at our discretion, make an additional charge to cover our administration costs in the following circumstances: Policy commencement, at renewal, mid-term adjustments, and cancellation or duplicate documents. Any fee charged will be agreed verbally with you prior to the aforementioned occurring and confirmed in writing. Fees are payable upon when placing insurance policies through us.
We receive commission from the insurance provider from any policy undertaken through us. This is typically for 48 months. If you would like to know the amount of commission we receive in respect of your insurance contract, this information is available on request. We shall only withdraw commission after we have received the premium from you, and in accordance with FCA regulations and agreements we hold with Sesame Limited and our Insurers.
Other Taxes & Costs
Other taxes or costs, or both, may exist in relation to the products and services offered by us which are not paid through, or imposed, by us. There is zero VAT on insurance products and we do not charge VAT or claim back any VAT on any policies undertaken through us.
Financial Services Compensation Scheme
You are covered by the FSCS as we are governed by the Financial Conduct Authority (FCA). You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim. Insurance advising and arranging is covered for 90% of the claim, without any upper limit. For compulsory classes of insurance, insurance advising and arranging is covered for 100% of the claim, without any upper limit. Further information about the compensation scheme arrangements is available from the FSCS.
This agreement shall be governed by the Laws of England and Wales and the parties agree herewith that any dispute arising out of it shall be subject to the (none) exclusive jurisdiction of the English Courts.
